Erudite Education Academy Pte Ltd (the “Company”) is committed to ensuring that your personal data is protected.

 

The purpose of this document is to explain how the Company manages personal data which is subjected to the Singapore Personal Data Protection Act 2012.

 

 

1. Purpose of Collection, Use and Disclosure of Personal Data

 

The personal data that we collect is used by us for the following purposes:

 

a. verifying your identity;

 

b. informing you of our value-added workshops, seminars, study tips or holiday workshops;

 

c. responding to, processing and handling your queries, requests, feedback and suggestions;

 

d. requesting feedback or participation in surveys, as well as conducting market research and/or analysis for statistical profiling or other purposes for us to design our products, understand customer behaviour, preference and market trends, and to review, develop and improve the quality of our products and services;

 

e. for our marketing, branding, communications and corporate affairs purposes which include publication in our printed materials, social media, website and/or electronic media.

 

For example:

  1. Taking of your photographs and the Student’s photographs in all activities organised by the Company in and out of our premise; use, displaying and publishing them in any the Company’s printed/publicity materials, social media, website and/or electronic media.

  2. Managing the administrative and operational aspects of the Company and complying with internal policies and procedures;

 

f. managing the safety and security of our premises and services.

 

 

2. To whom your personal data may be disclosed

 

The personal data that we collect may be disclosed to third party service providers whom we engage or collaborate with to organise/conduct our enrichment programmes, events, workshops, talks and seminars.

 

 

3. Security of Personal Data

 

The Company will take reasonable steps to protect personal data in our possession or under our control by making reasonable security arrangements to prevent unauthorised access, collection, use and disclosure of these personal data.

 

Occasionally, at our discretion, we may include or offer third-party products or services on our website. These third-party sites have separate and independent privacy policies. We therefore provide no warranty, have no responsibility or liability for the content and activities of these linked sites. Nonetheless, we seek to protect the integrity of our site and welcome any feedback about these sites.

 

 

4. Accuracy of Personal Data

 

It is your obligation to ensure that all personal data submitted to us and retained by us are accurate, not misleading, updated and complete in all aspects. Failure on your part to do so may result in our inability to provide you with the products and services you have requested. For the avoidance of doubt, we shall not be responsible for any personal data submitted by you to us that may be inaccurate, misleading, incomplete or not updated.

 

 

5. Personal Data relating to a Third Party

 

If you provide us with personal data relating to a third party (e.g. information of your spouse, children, parents, and/or guardians), by submitting such information to us, you represent to us that you have obtained consent of the third party to provide us with their personal data for the respective purposes. You should ensure that all personal data submitted to us is complete, accurate, true and correct. Failure on your part to do so may result in our inability to provide you with the products and services you have requested.

 

 

6. Retention of Personal Data

 

We will retain your personal information either for a period of our business relationship, or as long as you have any form of ongoing relationship with us, or for the requisite retention periods as stipulated in any contractual arrangements or under any applicable law, whichever is the later.

 

 

7. Access and Correction of Personal Data

 

An individual, based on reasonable grounds, may apply to identify how his/her Personal Data is being used or disclosed by the Company, to access his/her Personal Data held by the Company, and to request for his Personal Data to be updated or corrected.

 

An individual may do so by sending a formal written request to our Data Protection Officer. Upon receipt of such a request, Our Company shall verify the identity of the individual before responding to the request for access or correction and may also request for additional information regarding the request and/or the individual. Where applicable, the Company will advise the individual of any relevant processing fees before fulfilling the request.

 

8. Personal Data Protection Policy Updates

 

We may update this policy from time to time. If so, we will make the updated policy available at our website at https://www.erudite.sg/privacy-policy.

By providing us your personal data, you declare that you have read, understood and accepted the provisions herein and do hereby consent to the processing of your personal data in accordance with all the foregoing.

Registration Terms and Conditions

 

Interpretation 

 

1. In these Terms and Conditions, the following words and phrases shall bear the following meanings, unless the context requires otherwise: 

 

  • Erudite Education Academy Pte Ltd (the “Company”) is registered in Singapore under the Business Registration Number 202204884D; 

  • “Academic Year” means an academic year at Erudite Education Academy, which runs from 21st of November 2024 to 19th of November 2025; 

  • “Student” means children under the age of 21 and in Primary, Secondary, and Tertiary institutions. All Student(s) will require parental consent; 

  • “Parents” means the parents of the Student and any person or guardian who has or has accepted parental or legal responsibility for the Student. Parents are responsible, individually and jointly, for complying with their obligations under these Terms and Conditions;

  • “Staff” means any officer, teacher, employee, agent, service provider, representative or contractor of Erudite Education Academy Pte Ltd, whether located in Singapore or outside of Singapore;

  • “Billing Cycle” means course fee(s) billed once every month (4 to 5 lessons) or term (11 to 13 lessons);

  • “Calendar Month” means a full month commencing on the 1st day of a calendar month and ending on the last day of that calendar month. 

 

 

Conditions of Registration 

 

2. The enrolment/continued enrolment of the Student in the course(s) indicated on the Registration Form (the “Registered Course(s)”) shall be conditional upon, inter alia: 

 

  • the Company will contact the Student to determine his/her suitability for the Registered Course(s); 

  • payment of a refundable deposit (the “Deposit”) of SGD$50 for each Registered Course(s), upon the registration of the Student’s enrolment in the Registered Course(s). For the avoidance of doubt, and subject to these General Terms, the Deposit shall be used to pay for any outstanding amounts owed to the Company, which shall include but is not limited to:

    • any outstanding course fee(s) for the Registered Course(s);

    • advance payment of the course fee(s) of all Registered Course(s) before the first day of Billing Cycle.

  • payment of a $50 registration fee (the “Registration Fee”), upon the registration of the Registered Course(s); 

  • advance term payment of the course fee(s) of all Registered Course(s) before the first day of Billing Cycle. 

 

3. In the event that course fee(s) due for any Billing Cycle remain(s) unpaid by the start of that Billing Cycle, the Company shall disallow the Student from attending any class(es) in the Registered Course(s). 

 

4. Notwithstanding anything in these General Terms, the Student is not entitled to receive any materials for any classes which he/she has not paid for. In the event that the Student is registered for any of the Registered Course(s) after an Academic Year has begun, the Student shall be entitled to receive worksheets only from the date on which he/she begins attending the Registered Course(s). 

 

5. The Company reserves the right to transfer, suspend and/or terminate the Student with immediate effect from or to any or all classes in the event that the Parent and/or Student breaches any provisions of the Contract, or the Company deems, in its sole discretion, that the Parent and/or Student demonstrates behaviour that is detrimental to the welfare or safety of the Staff or other parents and students of the Company, or prejudicial to good order or the reputation of the Company, or for any other reason that the Company deems fit and proper in its absolute discretion. In the event that the Student is terminated from Erudite Education Academy Pte Ltd pursuant to this clause, the Company will not be under any obligation to return any deposit or fees paid to the Company. Without prejudice to the generality of this clause, the Company may exercise its right, which shall include but is not limited to:

 

  • cause or threaten to cause physical injury to other parents, students and/or Staff for any reason;

  • use threatening, abusive or insulting words or behaviour towards other parents, students and/or Staff;

  • harass, cause alarm or distress to other parents, students and/or Staff;

  • fail to comply with any policy, guidelines, code of conduct, regulation, notice, direction or instruction given by the Company or any Staff in relation to the conduct of classes or the use of the Company’s premises or items or any matter relating to the provision of the services;

  • persistently behave in a manner that is disruptive and prevents the continuation of classes or the provision of the services;

  • use, disclose or disseminate any of Erudite Education Academy Pte Ltd’s trademarks or copyright material without obtaining the Company’s prior written consent;

  • do not pay any fees payable to the Company and which are outstanding and remain unpaid as at the first week of commencement of the term.

 

6. Classes will not be held on the eve of Chinese New Year and any other public holidays which may be gazetted by the Government of Singapore from time to time. Should the Student have classes on these dates, the Company will inform the Student of the need to reschedule a make-up class, and no refund of course fees will be given in the event that the student is unable to attend the rescheduled make-up class. 

 

7. The Company shall not be obliged to refund any part of the course fees in the event that the Student fails to attend any class in the Registered Course(s) for any reason whatsoever. Subject to these General Terms, in the event that the Student does not turn up for classes and the fees for that Billing Cycle have already been paid, the Deposit and the fees will be forfeited.  

 

 

Make-up Classes 

 

8. In the event that the Student fails to attend a class in any of our courses, the Company may at its sole discretion, allow the Student to make-up the missed lesson by attending another ongoing class during the same academic week (i.e. from Thursday to Wednesday), provided that: 

 

  • there is more than 1 class; 

  • there is a vacancy in the class that the Student intends to attend as the make-up class; 

  • the Student or Parent submits either of the following original documents: 

    • medical certificate; or 

    • letter from the school, which states that the Student has compulsory school activities, the timing of which clashes with the Student’s classes at the Company. 

  

9. In the event that it is not possible to arrange a make-up class due to no vacancy in other classes, the course fees for the relevant Registered Course shall not be refunded or pro-rated, even if the Student has valid reason(s) for missing the class. If there are no other classes available in that lesson cycle, students will be offered to view the recorded lesson within a four-week time frame.   

 

 

Reimbursement of Registered Course Fee(s) 

 

10. Classes will not be held on the eve of Chinese New Year and all public holidays which may be gazetted by the Government of Singapore from time to time. Should the Student have classes on these dates, the Company will inform the Student of the need to reschedule a make-up class. No refund of course fees will be given in the event that the student is unable to attend the rescheduled make-up class. 

 

Withdrawals & Refunds 

 

11. A written Notice of Withdrawal must be given at least 4 weeks in advance of the start of the new term for any of the Registered Course(s). The Student will need to complete the lessons in the last paid billing cycle. Upon confirmation of withdrawal, the Deposit will be refunded by PayNow to the Parent/Guardian's account.

 

12. In the event that a Parent decides to withdraw the Student (regardless of reasons) with immediate effect or before the Registered Course(s) commence(s), the Deposit and Course Fee(s) will be forfeited. The written notice in Clause 10 will not be applicable in this instance and the company will not be obliged to refund any part of the Deposit. 

 

13. Unless otherwise stated, all monies paid are non-refundable and non-transferrable to another student, regardless of whether the Registered Course(s) has/have commenced. 

 

Intellectual Property & Media Rights 

 

14. Unless stated otherwise, the Company owns the intellectual property and/or licensing rights subsisting in all worksheets and other study materials distributed or used during the Registered Course(s), and both the Parent and Student are prohibited from copying, reproducing, modifying, distributing, displaying, performing or transmitting in any form or by any means whatsoever (including mechanical, electronic, recording, photocopying or otherwise) the abovementioned worksheets and other study materials without the Company’s prior written permission. 

 

15. The Company may copy, reproduce, display, distribute and use any photographs or videos taken of the Student during the Registered Course(s), as well as any intellectual property produced by the Student as part of the Registered Course(s). 

 

16. The Student hereby agrees to grant to the Company a royalty-free, perpetual, irrevocable, non-exclusive, transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such works of the Student created in the course of or in preparation for Registered Courses(s) (in whole or part) worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed. 

 

17. The Company may publish the Student’s academic achievements in any form or media at any time, even after the Student has withdrawn from the Course(s). 

 

 

Other Conditions 

 

18. The Company reserves the right to, and shall in its sole discretion:

  • (a) transfer, combine or dissolve a class, and/or

  • (b) terminate the Student’s place in any of the Registered Course(s). 

 

19. While the Company will take reasonable precautions to ensure the safety of the student, the Company assumes no liability for personal injury, loss or damage of any kind whatsoever which might be sustained by the student in undertaking any activity or anything during the Registered Course(s), whether under the discretion of the Company or otherwise, and generally for any such injury, loss or damage howsoever caused except by the wilful default of the Company. 

 

20. The Parent hereby releases the Company from all liability for such injury, loss or damage of any other kind whatsoever which might be sustained by the Student in undertaking any activity during the Registered Course(s) or/and in the premise, whether under the direction of the Company or otherwise, and generally for any such injury, loss or damage howsoever caused. 

 

21. The Company shall not be liable for any default due to any act of God, war, strike, lockout, industrial action, fire, flood, drought, tempest or other event beyond the Company’s reasonable control.  

 

22. The Registration Form and these General Terms contain the whole agreement between the Parent, Student and the Company, and supersedes any prior written or oral agreement between them relating to the Student’s enrolment in the Registered Course(s). The parties confirm that they have not entered into this agreement on the basis of any representations that are not expressly incorporated in the Registration/Renewal Form and these General Terms. 

 

 

PDPA Clause 

 

23. The Parent consents to the collection, use and disclosure of his/her personal data as well as the personal data of the Student in accordance with the purposes specified in the Personal Data Protection Policy.  

 

 

Worksheet Arrangements 

 

24. Online Classes 

Regular online students will have 2 options to obtain the worksheet:

 

  • Option 1: Parents to collect the notes (4 weeks’ worth) from the centre; or 

  • Option 2: Notes will be delivered to your doorstep free of charge. Any additional delivery requests will be subject to delivery charges (refer to details below). 

 

25. Centre-based Classes 

Worksheets will be distributed in class every week when the Student attends classes at the centre. Home delivery requests will be subject to delivery charges (refer to details below). 

 

  • Worksheet Check: If worksheets have been mailed to you, please check to ensure that you have all the worksheets indicated in the Item Description on the envelope’s shipping label and report any missing or incorrect worksheets immediately. Worksheet errors reported less than 1 day before class will result in a re-delivery and will be subject to delivery charges (refer to details below). 

 

 
Delivery Charges and Virtual Copies of Worksheets 

 

26. For home delivery requests and requests for virtual copies of worksheets, your first request for the month will be free of charge. Succeeding requests will be charged as follows: 

  • For virtual copies of worksheets* or home deliveries in 3 working days or more: $20

  • For express home deliveries: $30 (subject to availability)
